1. Acceptance of Terms

By accessing or using the Shybiz POS software and website ("Services") operated by Shyno Technology ("Company"), you agree to be bound by these Terms of Service. If you do not agree, you must not use our Services.

2. Description of Service

Shybiz provides a cloud-based Point of Sale (POS) software solution for restaurants and retail businesses. The service includes billing, inventory management, staff access control, analytics, and related features as described on our website.

3. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• You must be at least 18 years old to create an account

4. Subscription Plans & Payments

• Shybiz offers yearly subscription plans as listed on our pricing page
• Prices are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise
• Payment is due at the time of subscription or renewal
• We reserve the right to modify pricing with 30 days' advance notice
• Free trial periods provide full access with no payment required; your account will not be automatically charged after the trial ends

5. Your Data

• You retain full ownership of all business data you enter into Shybiz
• We will not access, use, or share your business data except to provide and improve the Service
• You may export or request deletion of your data at any time
• We maintain regular backups but recommend you keep your own backup copies

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or disassemble the software
• Resell, sublicense, or redistribute the software without written permission
• Interfere with or disrupt the integrity of the Service
• Upload malicious code or attempt to gain unauthorized access

7. Intellectual Property

The Shybiz software, website, logos, and all related content are the intellectual property of Shyno Technology. Your subscription grants you a limited, non-exclusive, non-transferable license to use the software for your business operations.

8. Service Availability

We strive for maximum uptime but do not guarantee uninterrupted service. We are not liable for temporary unavailability due to maintenance, updates, or circumstances beyond our control. The offline billing feature ensures your operations continue during internet outages.

9. Limitation of Liability

To the maximum extent permitted by law, Shyno Technology shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

• You may cancel your subscription at any time from your account settings
• We may suspend or terminate your account for violation of these Terms
• Upon termination, you may request export of your data within 30 days
• Provisions that by nature should survive termination will survive

11. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on our website. Continued use after changes constitutes acceptance.
